1. Acceptance of Terms and Eligibility

All products are subject to availability. In the event that a product you have ordered is out of stock or otherwise unavailable, we will notify you as promptly as possible and, at our discretion, offer you a substitute product of equal or greater value, or cancel your order and issue a full refund for that item. We reserve the right to discontinue any product at any time without prior notice.

Product images are for illustrative purposes only. Actual colors, dimensions, and features may vary slightly from the images displayed on the Website due to monitor settings, photographic lighting, or manufacturing variations. EyeZim is not responsible for minor discrepancies between product images and the actual products received, provided the products substantially conform to their descriptions.

We reserve the right to limit the quantities of any products that we offer and to refuse service to anyone for any lawful reason at our sole discretion, including but not limited to situations involving suspected fraud, abuse of promotional offers, or violation of these Terms.

3. Orders and Order Acceptance

When you place an order through the Website, you are making an offer to purchase the products in your cart subject to these Terms. All orders are subject to acceptance by EyeZim. We reserve the right, in our sole discretion, to refuse or cancel any order for any lawful reason, including but not limited to product availability, errors in product or pricing information, suspected fraudulent or unauthorized transactions, or any other reason that, in our judgment, makes acceptance of the order inadvisable.

After you submit an order, you will receive an automated order confirmation email acknowledging receipt of your order. This confirmation email does not constitute our acceptance of your order; it is merely an acknowledgment that we have received your order details. Our acceptance of your order, and the formation of a binding contract between you and EyeZim, occurs only when we send you a shipping confirmation email notifying you that your order has been dispatched, or when we otherwise notify you that your order has been accepted.

We may, prior to accepting an order, request additional information from you to verify your identity, payment method, or shipping address, or to prevent fraud. If we are unable to verify your information or if we determine that acceptance of your order poses a risk to our business, we may refuse or cancel the order and notify you accordingly.

You are responsible for ensuring that all information you provide when placing an order—including your name, shipping address, billing address, email address, and payment information—is accurate, complete, and current. EyeZim is not responsible for delivery delays, non-delivery, or other issues arising from inaccurate or incomplete information provided by you.

All orders are subject to our fraud detection and prevention procedures. If an order is flagged by our fraud detection systems or if we have reason to believe that an order may be fraudulent, unauthorized, or otherwise problematic, we reserve the right to cancel the order, refuse future orders from the same customer, and take any other action we deem appropriate, including reporting the matter to law enforcement authorities.

4. Pricing and Sales Tax

All prices displayed on the Website are in United States Dollars (USD) and are exclusive of applicable sales tax. The prices shown for each product do not include sales tax, which will be calculated and added to your order total at checkout based on the shipping destination and applicable federal, state, and local tax laws.

We strive to ensure that all pricing information on the Website is accurate; however, pricing errors may occasionally occur. If we discover a pricing error after you have placed an order, we will notify you as soon as possible and give you the option to either confirm your order at the correct price or cancel the order for a full refund. We reserve the right to change prices for any products at any time without prior notice. Price changes will not affect orders that have already been accepted by EyeZim (as evidenced by a shipping confirmation email or other acceptance notification). Promotional prices, discounts, and special offers are subject to the terms and conditions of the specific promotion and may be modified or discontinued at any time.

All payments must be made in full at the time of purchase. We do not offer installment payment plans or deferred payment options unless expressly stated at checkout through a third-party payment provider.

5. Payment

By providing a payment method, you represent and warrant that you are authorized to use that payment method and that all payment information you provide is accurate and complete. You authorize EyeZim and our payment processors to charge the payment method you provide for the total amount of your order, including the purchase price of the products, applicable sales tax, and any applicable shipping charges (if any—note that shipping within the United States is currently free on all orders).

If your payment is declined, your order cannot be processed. We are not responsible for any fees, charges, or overdraft fees imposed by your bank or payment provider as a result of a declined payment. You are responsible for ensuring that your payment method has sufficient funds or credit available to complete your purchase.

In the event of suspected fraudulent use of a payment method, we reserve the right to refuse or cancel any order, request additional verification, and report the matter to the appropriate financial institutions and law enforcement authorities.

6. Shipping and Delivery

For orders shipped within the United States, shipping is free. There are no shipping costs or fees. We currently ship to addresses within the United States; please refer to our Shipping Policy for information on eligible shipping destinations and any restrictions.

Standard delivery time for orders shipped within the United States is 3-5 working days from the date of shipment. This delivery time is an estimate only and does not include order processing time. Please allow additional time for order processing, verification, and fulfillment before your order is dispatched. Delivery times may vary depending on your location, the shipping carrier, and factors beyond our control, including but not limited to carrier delays, weather conditions, natural disasters, public health emergencies, or other unforeseen circumstances.

Once your order has been dispatched, you will receive a shipping confirmation email containing tracking information (if available). You are responsible for monitoring the tracking information and being available to receive the shipment at the address you provided. If a delivery attempt is made and no one is available to receive the package, the carrier may leave a notice and attempt redelivery or hold the package for pickup in accordance with the carrier's policies.

EyeZim is not responsible for delays, non-delivery, or loss of packages caused by incorrect or incomplete shipping addresses provided by you, your failure to be available to receive the shipment, or any other circumstances beyond our reasonable control. If a package is returned to us due to an incorrect address, refusal of delivery, or your failure to claim the package, you may be responsible for return shipping costs and any additional fees incurred.

Title and risk of loss for products pass to you upon delivery to the shipping carrier. If your shipment is lost, damaged, or stolen after delivery to the carrier, please contact us at contact@eyezim.shop and we will assist you in filing a claim with the carrier or, at our discretion, offer a replacement or refund in accordance with our policies and applicable law.

7. Returns and Refunds

EyeZim offers a 30-day return policy. Detailed information regarding returns, refunds, exchanges, and the conditions and procedures for returning products is set forth in our Return Policy, available on the Website. By placing an order, you acknowledge that you have reviewed and agree to the terms of our Return Policy.

There is no statutory cooling-off period or right of withdrawal for online purchases under United States federal law. Our 30-day return window is a voluntary policy offered by EyeZim and is subject to the terms and conditions set forth in our Return Policy, including but not limited to requirements that products be returned in their original condition, unused, and in original packaging.

If you wish to return a product, you must contact us at contact@eyezim.shop within 30 days of receipt of the product to request a return authorization and obtain return instructions. Returns made without prior authorization or outside the 30-day return window may not be accepted.

Refunds, if approved, will be issued to the original payment method used for the purchase, and may take several business days to process depending on your financial institution.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website and its Content solely for your personal, non-commercial use and solely for the purpose of browsing the Website and purchasing products for your own use.
